CITY OF NEW ORLEANS HOME RULE CHARTER AMENDMENT PROPOSITION PROPOSITION A - MINIMUM WAGE CITY CHARTER AMENDMENT SUMMARY: A PROPOSITION TO ADD A NEW CHAPTER 5 TO ARTICLE IX OF THE HOME RULE CHARTER OF THE CITY OF NEW ORLEANS IN ORDER TO ESTABLISH A MINIMUM WAGE OF $6.15 PER HOUR, OR $1.00 ABOVE THE FEDERAL MINIMUM WAGE, WHICHEVER IS GREATER, FOR INDIVIDUALS EMPLOYED AND PERFORMING WORK IN THE CITY OF NEW ORLEANS FOR OR ON BEHALF OF AN EMPLOYER.
City of New Orleans, Prop A, City Council, HRC
Passed: 62.7% voted yes and 37.3% voted no.
What the ballot said
Shall the Home Rule Charter of the City of New Orleans be amended, effective ninety (90) days after approval of this proposition by a majority of voters voting on this proposition, by adding a new Chapter to establish a minimum wage for individuals employed and performing work in the City of New Orleans for or on behalf of an employer? Under this proposal, the New Orleans minimum wage would be six dollars and fifteen cents ($6.15) per hour or one dollar ($1.00) above the federal minimum wage, whichever is greater. The proposal would also permit the City Council to increase the rate in the future and would establish fines for employers that violate the law. The proposal would also provide for a "tip credit" of up to 50% of the New Orleans minimum wage for tipped employees who regularly receive more that $100 per month in tips, and would exempt from coverage certain employees who are currently exempt from coverage under the federal minimum wage law (the Fair Labor Standards Act), as well as city and state civil service employees and persons employed on public works contracts. Specifically, the proposal exempts from coverage persons who are excluded from the definition of "employee" in subsections (e) (1), (2) and (4) of Section 3 of the Fair Labor Standards Act (FLSA); or who are exempted from the minimum wage under subsections (a), (d) and (g) of Section 13 of the FLSA; or who are employed at a reduced wage in compliance with the provisions of Section 14 of the FLSA and /or pursuant to a valid permit or certificate issued under authority of Section 14 of the FLSA; or who are state or city civil service employees whose wages are regulated by a civil service commission; or who are employed on any public works project contract governed by the Louisiana Public Bid Law. The entirety of the proposed amendment is contained in Appendix "A" to Ordinance Number 20376 M.C.S.
